How will you use my data?

When you book a stay with us

When you book a stay with us, we’ll use your personal information to confirm your booking. The data we collect from you will include your name, address, payment and other contact details, including your e-mail address.

To finalise your booking, we share your personal data with our subcontractors who are involved in the booking process, such as payment providers, as well as credit reference agencies that we use to assess fraud, credit, and security risks.

We then need to process your personal information in order to conclude and execute the booking contract for the stay you have booked.

Per the terms of the preferences selected, we will also consider each booking as an “expression of an interest in a stay with us”. Please also read the relevant section below.

When you call us

When you call us, we may also process your personal information (your name, contact details, and any other data you may provide us with during the call) in order to provide the customer support services you have requested.

We may do so when you ask us to confirm whether a particular holiday property is available or explain how our holiday booking process works.

We require your consent to process your personal data. If you do not provide us with the personal data we request for customer service purposes, we may not be able to fully respond to your enquiries.

When you expressed an interest in a stay with us

If you agree to receive marketing communications from us via our website or over the telephone, we will process your personal data, (for example – your name, email address, postal address and telephone number) to provide you with marketing communications in line with the preferences you have provided us with.

When we send you marketing emails, we require your consent to contact you for marketing purposes. Each email we send you for marketing purposes will contain instructions on how to unsubscribe.

When we send you marketing material by post, we do so based on our legitimate interest in informing you of our latest holiday deals. You are in no way required to provide us with your personal data for marketing purposes.

You can let us know that you are not interested in your personal information being processed for this purpose at any time, by contacting us at rochabrava@rochabrava.com or, if applicable, by clicking on the link provided in each marketing communication you receive from us.

To improve our website

We will also use your personal information to provide you with a more efficient user experience (specifically by showing you holidays that we think may interest you based on your purchase history and browsing habits).

Our use of your information for this purpose means that your experience of our site will be more personalised to you, and that the stays displayed to you on our website may differ from those displayed to other individuals with different shopping histories and browsing habits.

We also share your aggregate anonymous data with external analytical data providers and search engines that help us improve and optimise our website.

We will also use your personal data to make our website more secure and to administer it, as well as for internal operations, including troubleshooting, analysing data, conducting tests, research, and for statistical and study purposes.

We process your data for this purpose because we have a legitimate interest in providing you with the best possible experience, and to ensure that our site remains secure.

If we sell our business

We will transfer your personal data to a third party:

  • If we buy or sell any business or goods, in which case we will provide all personal data to the seller or buyer (but only to the extent necessary and always in compliance with data protection legislation); or
  • If the Rocha Brava Village Resort or the majority of its assets are acquired by a third party, in which case the personal information held by the Rocha Brava Village Resort will be transferred to the buyer.

We process your personal information for this purpose because we have a legitimate interest in ensuring that our business can be continued by the buyer. If you object to us using your personal information in this way, the respective seller or buyer of our business may not be able to provide you with any services.

In some circumstances, we may also need to share your personal information if we are under an obligation to disclose or share data to comply with a legal obligation.

How about where technical and analytical information is concerned?

Information we collect about you

When you visit our website we will automatically collect the following information:

  • Technical information, including the Internet protocol (IP) address used to connect your computer to the Internet, your registration information, search engine type and version, time zone setting, search engine plug-in types and versions, screen resolution, operating system and platform; and
  • Information relating to your visit, including Uniform Resource Locators (URL), clickstream data to, through, and from our site (including date and time), page response times, download errors, length of visit to certain pages, page interaction information (such as movements, clicks, and mouse movements) and methods used to navigate away from the page.

Information we have received from other sources.

We work closely with networks of external advertising providers, analytics data providers, hosting providers and search information providers from whom we may also receive general aggregated anonymous information about you.

We will combine the information you provide with the information we collect about you.

Where is my data stored?

The data we collect from you will be stored in a location within the EU.

All the information you provide is stored on our secure servers or on the servers of our external booking agents. When we have given you (or you have chosen) a password that allows you to access certain parts of our site, it is your responsibility to maintain the confidentiality of your password. Do not share your password with anyone.

How long do we keep your data?

When you have booked a holiday with us, we will retain your data for a period of 7 years for legal purposes, to ensure that we are able to support you in the event that you have any questions, feedback, or issues relating to a stay you have purchased from us or should any legal issues arise – a VAT issue, for example.

When we have used your personal information to contact you for marketing communications.

  • We will send you our email communications for 5 years. There will be a link within each email to allow you to unsubscribe from receiving them at any time during this period.
  • We will contact you every 5 years to ensure that you are happy to continue receiving postal and telephone communications from us.

If you tell us that you no longer wish to receive marketing communications from us, we commit to stopping sending them to you.

When we have processed your data for any other reason (such as when you have contacted us with a question relating to a possible holiday booking) we will keep your data for 3 years.

Your right to object under data protection legislation

You have the right to object to the processing of your personal information when

  • Based on our legitimate interests (as described in the “How will you use my data?” section above). If you ask us to stop processing your personal information, we will do so unless we can demonstrate to you that we have compelling reasons why our use of your personal information should continue
  • For marketing purposes. If you ask us to stop processing your personal information on this basis, we will stop processing it.

What are my rights under the data protection legislation?

Right of access

You have the right to receive confirmation as to whether or not your information is being processed by us, as well as other information regarding our use of your personal information.

You also have the right to access any personal information of yours processed by us.

Right to rectification

You have the right to request the rectification of any incorrect personal information we hold about you. You also have the right to rectify incomplete personal information we hold about you by providing a supplementary statement.

  • you believe we hold incorrect personal information about you
  • us processing your personal information violates the law, but you do not want us to delete it
  • we no longer need to process your personal information, but you want us to do so for legal reasons

When you exercise your right to restrict our use of your personal information, we will only process your personal information to the extent accepted, except for the purposes of storing and processing legal proceedings.
